International child abduction

The Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction, which entered into force on 1 December 1983, applies to any wrongful removal of children habitually resident in a Contracting State. It applies to minors under the age of 16, with the 1996 Hague Convention taking over for minors aged 16 to 18.

This convention provides that the removal or retention of a child is unlawful when there is a violation of a custody right granted by the law of the State in which the child had his or her habitual residence immediately before being removed and if that custody right was effectively exercised.
